Elevate Engine Application Privacy Policy

This Privacy Policy describes how Elevate Franchise Brands (“Elevate,” “we,” “us,” or “our”) collects, uses, and discloses information related to the use of the Elevate Engine mobile application (the “App”) by authorized franchise owners and their designated employees (each, a “Franchise User” or “User”) operating under an active Franchise Agreement.

IMPORTANT NOTE: This policy governs the handling of information related to Franchise Users and App operation only. This policy does not cover the handling of end-customer Personally Identifiable Information (PII) which is governed by your primary Franchise Agreement, the privacy policies of the Integrated Platforms (Go High Level and ServiceTitan), and applicable consumer privacy laws.

BY ACCESSING OR USING THE ELEVATE ENGINE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS PRIVACY POLICY.

1. Information We Access and Collect

We collect or access several types of information from and about Franchise Users:

1.1. Data Accessed from Integrated Platforms

The primary function of the App is to serve as an interface to operational data. We do not store this data centrally but access it via the Integrated Platforms:

  • Source Data: Operational, customer, and financial data sourced from ServiceTitan and routed through the Go High Level platform. This includes, but may not be limited to, job details, customer records (PII, contact information), pricing, performance metrics, and scheduling information.
  • Basis of Access: This access is necessary for the proper functioning of your franchised business and is governed by your Franchise Agreement and the terms of service of the Integrated Platforms.

1.2. Information Provided by Franchise Users

  • Account Information: Login credentials (user IDs, passwords, or authentication tokens) necessary to authenticate you into the App and the Integrated Platforms.
  • Contact Information: Name, email address, phone number, and franchise location details, used for administrative and support purposes.

1.3. Automatic Collection and Usage Data

When you access and use the App, we automatically collect:

  • Usage Details: Information about how you use the App, including navigation patterns, time spent on features, and interactions.
  • Device Information: Information about your mobile device and internet connection, including the device’s unique identifier, operating system, browser type, and mobile network information.
  • Diagnostic and Error Data: Information about crashes, errors, and performance issues within the App.

2. How We Use the Information

We use the information we collect or access for the following business and operational purposes:

  • To Provide and Maintain the App: To operate, deliver, and troubleshoot the Elevate Engine service and ensure access to real-time Integrated Platform data.
  • Franchise Performance Monitoring: To track, analyze, and report on the operational performance of your franchised unit in accordance with the Franchise Agreement.
  • Internal Analysis and Improvement: To analyze usage trends, improve the App’s features and functionality, and optimize user experience.
  • Security and Compliance: To detect, prevent, and respond to fraud, unauthorized access, security risks, or breaches of the Franchise Agreement or these Terms.
  • Communication: To send you technical notices, updates, security alerts, and support and administrative messages related to the App.

3. Disclosure of Your Information

We may disclose the information we collect or access in the following ways:

  • To Elevate Affiliates: To Elevate Franchise Brands corporate entities, brands, and affiliated companies for internal reporting, strategic planning, and support purposes.
  • To Service Providers: To contractors, service providers, and other third parties who support our business, including cloud hosting providers, analytics services, and technical support partners, all of whom are bound by contractual obligations to keep personal information confidential.
  • To Integrated Platforms: Data access is inherently shared with Go High Level and ServiceTitan as they are the underlying platforms hosting the data.
  • Legal Requirements: To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • Enforcement: To enforce our rights under the Franchise Agreement or the App’s Terms and Conditions of Use.

4. Data Security

We have implemented reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, the safety and security of your information also depends on you. Franchise Users are responsible for keeping their login credentials confidential. We cannot guarantee the security of information transmitted through the App.

5. Changes to Our Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes to how we treat our Franchise Users’ personal information, we will notify you through a notice within the App or via the email address associated with your franchise account. Your continued use of the App after we make changes is deemed to be acceptance of those changes.
